Warranty Against Defects

This Warranty Against Defects is issued pursuant to and forms part of the supply Agreement between Advanced Navigation Pty Ltd (ACN 156 101 549)  (we, us or our) and you, the person or entity stated in the Work Order, together the Parties and each a Party

This Warranty Against Defects applies to the Goods and Services identified in the applicable Work Order.

For the avoidance of doubt:

  • if the Work Order provides that this Warranty Against Defects is available in respect of the Goods and Services in the Work Order, the rights in this Warranty are available to you in addition to any rights or remedies you have under the Australian Consumer Law or any other applicable law (Consumer Law Rights);
  • if the Work Order states that an Extended Warranty is available in respect of the Goods and Services in the Work Order, the Extended Warranty term for each type of goods/Services identified in the Work Order replaces the Warranty Period in this Schedule but otherwise, the terms of this Schedule apply in respect of the Extended Warranty.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

1. Warranty

1.1. We provide this Warranty to you in addition to any rights or remedies you have under the Australian Consumer Law or any other applicable law (Consumer Law Rights).

Additional Software1 year from the date of delivery of the Additional Software by us.Additional Software free from error which materially affects performance and, if applicable as defined in the Work Order and User Manual, be eligible for access to post contract support and software updates when available.At our discretion, we will resupply the Additional Software or issue a full or partial refund to you with respect to any amount paid for the defective part (or all) of the Additional Software.
Certus category products and Motus category products, and Compass products, and Chimera category products1 year from the date of delivery of the Goods from us or if applicable, the date of collection by you of the Goods from usProducts defective by reason of improper workmanship or materials and/ or do not confirm to any specifications provided in a Work Order.At our discretion, we will repair the Goods or resupply the Goods or issue a full or partial refund to you with respect to any amount paid for the defective part (or all) of your Goods.
All Accessories including cables, routers, chargers, dust caps, magnetic wands, and antennas90 days from the date of delivery of the Goods from us or if applicable, the date of collection by you of the Goods from usProducts defective by reason of improper workmanship or materials and/ or do not confirm to any specifications provided in a Work Order.At our discretion, we will repair the Goods or resupply the Goods or issue a full or partial refund to you with respect to any amount paid for the defective part (or all) of your Goods.

1.3. Subject to the terms of this Warranty, if during the Warranty Period the Goods or Services prove Defective, we will meet the Warranty Offer. Your Consumer Law Rights may extend beyond the Warranty Period.

1.4. If any materials, parts or features required to facilitate any repair or replacement pursuant to clause 1.2 are unavailable or no longer in production, or model of Goods is no longer available or in production, we will use our best endeavours to use appropriate equivalent materials, parts, features or model. 

2. Making a valid warranty claim

2.1. To claim the benefit of this Warranty, you must:

  • notify us by our designated support channel https://support.advancednavigation.com/ as soon as you become aware that the Goods or Services are Defective with evidence of proof of purchase of your Goods or Services from us and a description and photographs of the claimed Defect;
  • if we ask you to, you must return to return the Goods together with all packaging, parts, accessories and documentation to the contact details set out below; 
  • provide any other information reasonably required by us to assess your claim.

2.2. Where you return the Goods as part of a Warranty claim under this clause 2.1, you will need to cover any associated costs of you returning the Goods to us.

2.3. Where we accept your claim under this Warranty, clause 1.2 (above) will apply.

3. When this warranty applies and when it does not

3.1. This Warranty does not cover any defect which is caused (or partly caused) or contributed to, by any:

  • act or omission, accident, or negligence by you or any third party not engaged by us (including any third party installer of your Goods or the Services);  
  • failure on your part to follow any instructions or guidelines (including any manual) provided by us in relation to your Goods or the Services or properly maintain your Goods in accordance with any of our instructions or guidelines (including any manual);
  • use of your Goods otherwise than for any application or use specified by us;
  • use of Goods that is expressly prohibited by us in any sales documentation that we provide or as specified in any Special Condition in a Work Order;
  • continued use of your Goods (where such use is not reasonable) after any defect in your Goods becomes apparent or would have become apparent to a reasonably prudent person;
  • incorporation or installation of fixtures, appliances, software not licensed to you by us or other items into your Goods or Services;
  • failure by you to notify us of any defect in your Goods or Services within a reasonable period of time after you become aware of or ought to have reasonably become aware of the relevant defect;
  • reasonable wear and tear of your Goods;
  • Force Majeure Event; or
  •  repair, maintenance, altering, overhauling or otherwise compromise of the Goods or Services by you or any person other than us.

3.2. Additional Expenses: Any works or services requested by you to be performed by us (including any work or services that are additional to repairs carried out by us pursuant to clause 1.2 and deemed by us to not be covered under this Warranty may incur additional charges, which we will advise you of prior to commencing those additional work or services.  We are under no obligation to perform any additional work or service that you may request.

3.3. Term of Warranty: Where we replace any parts under this warranty, this will not extend the Warranty Period in clause 1.2.

4. General

Clause 4.1 Warranty prevails: In the event of any inconsistency or ambiguity between this Warranty and the Terms, this Warranty will prevail. In the event of any inconsistency or ambiguity between this Warranty and the Work Order, the Work Order terms will prevail.

4.2. Validity: This Warranty is enforceable in Australia and is governed by the laws of New South Wales. If you purchase our Goods and Services outside of Australia, to the maximum extent permitted by Law, the statutory warranties in the Australian Consumer Law do not apply in respect of our Goods and Services but you may rely on the benefit (if any) of this Warranty.

4.3. No third party reliance: The benefit of this Warranty is for you (the initial owner of our Goods & Services) only, and no other person or third party can rely on or make a claim under this Warranty.

4.4. No Assignment or transfer: This Warranty or the benefit under this Warranty cannot be assigned or transferred to any other person or third party except in the case of the resale of our Goods and Services by our authorised reseller, where the benefit of the Warranty is intended for end users of our Goods and Services as our authorised reseller acts as a distributor on our behalf.

4.5. Severance: If any provision of this Warranty is held to be void, invalid or illegal or unenforceable in any jurisdiction, that provision is to be read down as narrowly as necessary to allow it to be valid or enforceable, failing which, that provision (or part of that provision) will be severed from this Warranty without affecting the validity or enforceability of the remainder of that provision or the other provisions in our Agreement.

4.6. Definitions: Unless otherwise defined herein, capitalised terms have the meanings given to them in the applicable Work Order and/or https://www.advancednavigation.com/terms/.
